# Russia won anti-dumping dispute with the European Union

WTO made the right decision.

World Trade Organization (WTO) declared the EU’s Cost Adjustment Methodology inconsistent with anti-dumping duties on ammonium nitrate exported from Russia. As follows from WTO’s report, the existing EU’s anti-dumping measures also recognized illegal.

“Russian Fertilizer Producers Association (RFPA) welcomes the decision of WTO on the dispute between Russia and the European Union regarding energy adjustments and anti-dumping duties on ammonium nitrate,” commented President of RFPA and PhosAgro CEO Andrey Guryev on the panel’s conclusion.

Based on the panel’s report, Russian mineral fertilizer producers request to conduct an anti-dumping investigation in the EU and to immediately call-off anti-dumping duties on ammonium nitrate export from Russia.

In 2015, WTO received Russia’s claim regarding incorrect cost adjustment methodology used by the EU to take anti-dumping duties on the supply of ammonium nitrate. The European Union took into account European prices for gas and electricity while calculating the costs of the ammonium nitrate production by Russian companies. Thus, accusations of dumping against Russian producers were based on deliberately inflated cost estimates.

For over 20 years, the European Union has applied anti-dumping duties on the import of ammonium nitrate from Russia. The last time the European Union revised these duties in 2018 and set them at the level of $32.71 per ton for all Russian suppliers.
