# Bayer faced the new problem in the US

Phosphorites cannot be mined.

Idaho Supreme Court (USA) granted a class-action lawsuit filed by environmental organizations against the construction project of the Caldwell Canyon phosphorite mining facility.

According to the court’s decision, the US Bureau of Land Management violated applicable law and couldn’t assess the extent of the negative impact of Caldwell Canyon on the environment, in particular on the habitat of the endangered sage grouse. Therefore, the permit issued by the US Bureau of Land Management was invalidated.

Caldwell Canyon should have mined phosphorites for P4, a subsidiary of the German chemical giant Bayer, to produce glyphosate.
