Ostchem proved they didn’t abuse the position

Three enterprises of the Ostchem Group (Severodonetsk Azot, Cherkasy Azot and Rivne Azot) won a lawsuit against the Antimonopoly Committee of Ukraine. The Northern Commercial Court of Appeal declared illegal the decision of the Antimonopoly Committee of Ukraine on Ostchem forced separation dated September 5, 2019. The Antimonopoly Committee also intended to recover the maximum possible fine of UAH 107 million (about $3.8 million).

The Northern Court upheld the decision of Kiev Commercial Court, which declared illegal the claim against the Ostchem group that the company occupies a dominant position in the country’s nitrogen fertilizer market.

We’d like to remind you that on July 29, 2020, the Ostchem Group appealed the decision of the Antimonopoly Committee of Ukraine on the abuse of the monopoly position and the forced separation of the Group in the Kiev Commercial Court.
